The position of trustee of a trust is a serious one that carries with it a number of legal duties. The court takes a dim view of any trustee who fails to act in an appropriate manner when carrying out those duties.
We assist both existing trustees in dealing with trust issues arising and also trust beneficiaries who feel that there are issues that need resolving in respect of the management of their trust.
Very often, trusts created within families either in life or by will span a number of generations within that family. Disputes and problems that arise are therefore serious and far reaching matters that require a sensible and direct approach to resolution. We are involved not just in court applications seeking such resolution but more and more these disputes are being solved by using alternative dispute forums and methods such as mediation. We have been involved in many mediations and the resolution success rate is extremely high with almost 90% of mediations giving rise to an agreement (from a sample of over 100 mediations held).
The team is led by Martin Holdsworth, one of only 3 lawyers recognised outside London as a specialist in this area of law by Chambers and Partners 2014. He has been recommended by the Legal 500 for the last 5 years and is a national committee member of the Association of Contentious Trust and Probate Specialists (ACTAPS).
