<p>In 2026 more couples who are divorcing and separating are expected to choose non-confrontational ways to legally end their relationship and put their children’s best interests first. &nbsp;&nbsp;</p>



<p>Among the options available to couples who want to deal with the consequences of their separation in a spirit of cooperation is collaborative family practice, where couples commit to avoid the court route and work together with specially trained lawyers to make their own decisions about the future.&nbsp; &nbsp;&nbsp;</p>



<p><strong>How does it work &#8211; and who is involved?</strong></p>



<p>You and your ex each appoint your own collaboratively trained lawyer and have a series of meetings where you all work together to identify, address and resolve financial, parenting and other key issues. <a href="https://www.jonesmyers.co.uk/family-law-services/divorce-separation/mediation/">Like mediation</a>, the process is entirely confidential.&nbsp; &nbsp;&nbsp;</p>



<p>Collaborative family lawyers&nbsp; provide support and legal advice throughout the sessions. Accountants, independent financial advisers, pensions advisers and/or childcare specialists can also attend and provide guidance on a neutral basis. You have as many or as few meetings as are necessary to resolve the issues between you.&nbsp;</p>



<p>At the outset you, your collaborative lawyers and any other specialists involved sign a Participation Agreement that commits all of you to strive to reach resolutions without going to court.</p>



<p>The Agreement&nbsp; prevents your collaborative lawyers from representing you in court if the collaborative process breaks down, ensuring everyone is wholly bought into making the process work.&nbsp;&nbsp;&nbsp;</p>



<p><strong>What are the advantages and disadvantages?</strong></p>



<p>Like mediation, collaborative family&nbsp; practice puts you and your ex in the driving seat so you can progress the sessions at your own pace, working around your respective work and family commitments.</p>



<p>Faster, less stressful and more cost effective than going to court, it ensures that everyone involved is committed to achieving a solution. In times where transparency is encouraged in the family courts and journalists can attend hearings, collaborative practice guarantees your family’s privacy.</p>



<p><strong>What happens if a successful outcome is reached</strong>?</p>



<p>Once an agreement is reached, your lawyers will formalise it, obtaining a formally binding Court Order without you having to go to court.</p>



<p><strong>What if talks break down?&nbsp; </strong><strong></strong></p>



<p>At any time during the sessions either of you can terminate the process through a Formal Notice of Withdrawal. Again, as in mediation, failure can be avoided with the right support, including where necessary, an early neutral evaluation or arbitration on disputed legal issues.</p>



<p><strong>How does this process differ from mediation?</strong></p>



<p>In mediation, family mediators are neutral – they cannot give advice to either of you as their role is&nbsp; to facilitate discussions leading to your own decisions being made.</p>



<p>Collaborative family lawyers, however, can advise those they represent at the same time as conducting the negotiations. As highlighted above, they also sign an agreement to avoid court, providing a positive investment in the process for the whole team.&nbsp;&nbsp;</p>

<p>With the family justice system at a crucial turning point, <a href="https://www.jonesmyers.co.uk">Jones Myers</a> is backing a national campaign to create a fairer family justice system for all.</p>



<p>Organised by family justice group Resolution, Awareness Week 2023, which spans November 27- December 1, highlights the different ways families can resolve their disputes away from Court &#8211; where it is safe and appropriate to do so.</p>

<p>We applaud the Government’s plans to increase funding to give those <a href="https://d.docs.live.net/3b53212a7d7ebd45/Documents/Jones%20Myers/Blogs/2022/August/Litigants%20in%20person/Draft/Extra%20support%20for%20thousands%20of%20litigants%20navigating%20the%20legal%20system%20(familylaw.co.uk)">most in need access to legal support</a> and help more people to manage their legal issues in the early stages.</p>



<p>The assistance aims to prevent fewer people from becoming a ‘litigant in person’ and representing themselves in court, while also providing specialist legal guidance to those who go on to do so. &nbsp;&nbsp;</p>



<p>The dramatic increase in litigants in person has resulted from the 2013 demise of Legal Aid. Sadly, there are many cases where estranged parents cannot agree on key areas for their children’s welfare such as finance or living arrangements.</p>

<p>Mediation is an alternative way forward which puts <em>you</em> in the driving seat. In mediation you and your ex work constructively towards agreed arrangements aligned with your family’s long-term interests.</p>



<p>During mediation you and your ex discuss, confidentially with a qualified mediator, those issues which are most important to you. &nbsp;&nbsp;With the right mediator, there is no reason why financially complex issues cannot be agreed using the process.</p>



<p>Advantages of using mediation include financial and time savings as the process takes the time it needs to resolve your particular issues.&nbsp; This can be anything from one meeting in less complex cases to several meetings over a few months, where the background issues are more complicated.</p>



<p>This measured approach, which keeps communication channels open, can also lessen the emotional impact of the split on your children.</p>



<p>You will still need legal advice in support of the mediation process and the mediator will guide you as to when this is required.&nbsp; The amount of solicitor involvement is much more limited than in a conventional case however, which makes the legal costs much lower.</p>



<p>&nbsp;Where necessary, agreements reached in mediation can easily be incorporated into draft orders by your solicitors and approved by a Judge to be <a></a>made legally binding.&nbsp;</p>

<p>Jones Myers is delighted to start the New Year with the news that Partner, Nicki Mitchell, has further boosted her extensive expertise in mediation by becoming a qualified Child-inclusive mediator.</p>



<p>A qualified family law mediator since 2015, Nicki is among a handful of mediators in Yorkshire to achieve the CIM accreditation which enables her to meet with children whose parents have separated, and hear what they want for the future.&nbsp; &nbsp;</p>



<p>As York’s first qualified collaborative family lawyer who Heads Jones Myers York office, Nicki is at the forefront of processes such as mediation and collaboration which avoid a lengthy court process and seek to put children’s best interests first.&nbsp;&nbsp;</p>



<p>As a Child-inclusive mediator, Nicki will firstly see both parents who are required to give their permission for her to meet with their children on their own. The process usually involves children aged 10 or over, although younger children can be involved with their older siblings.</p>



<p>Once parents have consented, Nicki will make initial contact with the children to explain what the conversation would involve and ask them if they would like to do it. They are not asked to make choices or decisions about their personal situations. &nbsp;</p>



<p>If the children wish, they can ask Nicki to feed back to their parents.  However, they are under no obligation to do so.  There is a large volume of research which tells us that the conversation is beneficial for the children even if they do not want anything passed back.</p>



<p>David Massey, Admin Manager for the Family Mediators Association which awarded Nicki the accreditation, said: “Enormous congratulations to Nicki on furthering her mediation skills in this vital area. In our experience all parents find child-inclusive mediation very valuable at a time when they face difficult emotional, practical, legal and financial decisions. <p>Practising family law exclusively for over a quarter of a century, Norman has <a href="https://www.yorkshirebusinessdaily.co.uk/2021/10/13/pioneering-collaborative-family-lawyer-retires-after-46-years/">tirelessly championed collaborative family law</a> which avoids delays, stress and high costs associated with going to Court.&nbsp;</p>



<p>Norman’s commitment to developing the next generation of family lawyers has seen him involved in Leeds Beckett University’s Professional Mentoring Scheme since 2019. He has played a key role in facilitating the University’s Law School’s pro bono Law Clinic for students for the past three years. &nbsp;</p>

<p>Pensions are often one of the most valuable assets of a marriage and play a vital role in deciding financial claims on divorce.</p>



<p>Financial disclosure &#8211; a full statement of your current earnings and assets &#8211; aims to protect you both. It also looks to ensure that you each receive a fair settlement which may well include a division of the pension benefit fund.&nbsp;</p>



<p>Pension sharing &#8211; which provides a clean break between parties, as the pension assets are split &#8211; has been given more prominence in recent years. It recently hit the headlines when a <a href="\Users\Sharon\Documents\Jones%20Myers\Blogs\2021\February\Pension%20sharing\Draft\court%20battle%20to%20slash%20her%20unemployed%20ex-husband's%20share%20of%20their%20£2million%20fortune">BBC producer lost her court case</a> to reduce her unemployed ex-husband&#8217;s 33% share of her £2 million fortune. &nbsp;</p>



<p>In this particular case, The Court of Appeal reaffirmed that pension sharing is appropriate when deciding on the allocation of capital.&nbsp;</p>



<p>Judges took into account the length of the marriage and discounted the former wife’s allegation that her ex-husband had made a &#8216;significantly negative&#8217; contribution to the family fortune during the marriage.</p>



<p>They also upheld an earlier ruling and said the original £733,650 and pension share he was awarded would meet his &#8216;needs&#8217;.&nbsp;</p>



<p>The criteria in considering a pension share requires the pension fund to be valued and included in the list of the family’s assets. &nbsp;</p>



<p>The receiving party needs to decide if it’s better for them to receive a percentage share or, in some circumstances, seek a greater share of the liquid capital as a “set off” when not pursuing a share of the pension.</p>



<p>Some divorces may entail several pension arrangements so it is important you think about which arrangements should be shared.&nbsp;Expert advice from an Independent Financial Adviser is necessary to ensure the correct pension(s) are shared and to what extent.&nbsp;Advisors will also assist with the valuation and projected future incomes.</p>



<p>The pension share may be internal (when the recipient becomes a member of the scheme) or eternal when the share must be invested in an existing or new arrangement of the receiving party. Utmost care should be taken to obtain details of the cost of any transfer.</p>



<p>The court will look at the needs of the parties and take into account what other assets are available for distribution.</p>



<p>Agreed financial settlements avoiding Court can also be decided through <a href="https://www.jonesmyers.co.uk/family-law/finances/">alternative processes including Mediation</a> where an impartial third party “the mediator” helps you discuss issues confidentially and find workable agreements.</p>



<p>There is also Collaborative Family Law where a “no court” agreement is signed at the beginning of the process so that there is a shared commitment to finding an agreed resolution</p>



<p>Another option is Arbitration where a Family Law Arbitrator in the role of a ‘judge’ decides the outcome of divorce financial settlements. As one of the first UK Family Law Arbitrators qualified to decide the outcome of financial and property disputes, I am arbitrating on an increasing number of cases which often include pension arrangements.&nbsp;&nbsp;</p>



<p>With Mediation, Collaborative Family Law and Arbitration, once there is agreement (or an Award) details are submitted to the court for an order which enables a pension share to be implemented. &nbsp;</p>
