When couples divorce or terminate a civil partnership, a key issue is dividing any pension rights that have been built up during – and possibly before – the relationship started.

A recent divorce case, which has been widely reported and involved a substantial amount of money, has prompted family lawyers to sit up and question if the so-called ‘meal ticket for life’ regarding maintenance payments is coming to an end

The divorce case involved a wife who had received over £9 million and an additional £175.000 each year in maintenance.  However this was limited to a three year period by the Court of Appeal. (more…)

Our highly experienced team at Jones Myers has opened a new office at Windsor House, Cornwall Road in Harrogate as we mark our 25-year anniversary.

The milestone for our specialist family law firm, which operates out of Leeds and London, is to accommodate an increase in instructions from our clients in North Yorkshire.

A senior judge’s call for parents with valuable homes to be forced to pay more child support highlights a loophole in the system which is criticised as being unfair and does not put children’s interests first.

Since 2012, child maintenance payments have been based on income only, with assets not included in calculations by the Child Maintenance Service (CMS), which decides the rate. This means that people can live off their capital, declare a low income and pay minimal child support.

Along with dwindling annuity rates and the demise of defined pension schemes, it is a fact of life that divorcees’ retirement incomes are inevitably lower than those of non-divorcees.

A further downside is that from April 6, 2016, thousands of people who divorce, remarry or form a new civil partnership can no longer use ex-spouses’ National Insurance contributions to help increase their basic state pension. (more…)
